Can Children Inherit a Leasehold in Phuket?
Not automatically. Thai law treats a lease as a personal right of the tenant, so by default a villa lease in Phuket ends when the leaseholder dies, as Tilleke & Gibbins and ThaiLawOnline both explain. Children can carry it on when the contract shows the lease was never tied to one person: an express succession clause, rent paid in one sum for the whole term at the start, or freedom to sublet without the landowner's consent, the signs the Supreme Court accepted in judgment No. 11058/2559. The house can pass more simply when it is held through registered superficies, which heirs can inherit.

Why does a Phuket lease end with the leaseholder?
Because a lease is a contract with a person, not a share of the land. Thai courts treat the tenant as the essence of the agreement, and the explanation is the same in Tilleke & Gibbins, ThaiLawOnline and Thailand Law Online: unless the contract provides otherwise, the lease ends on the tenant's death.
For a holiday rental that rule changes nothing. For a villa bought on a 30-year lease it matters a great deal, because the price paid up front covered years the buyer may not live to use. The point of the clauses below is to make the contract say what the family assumes.
The rule is a default, not a ban. The same sources that state it describe how a contract can be written so that the lease survives the leaseholder, and the Supreme Court has confirmed that route.

Which clauses let the lease pass to children?
The ones that show the landowner did not care who the tenant was. In judgment No. 11058/2559, approved by the general assembly of the Supreme Court, the lease was held to continue to heirs because its terms showed that the lessor had waived the personal character of the lease. Tilleke & Gibbins point to two such terms: rent received in one payment for the entire duration at the start, and permission to sublease to third parties without the lessor's prior consent.
An express succession clause is the third tool. ThaiLawOnline notes that a lease ends with the lessee unless written otherwise, and a clause naming heirs is how it is written otherwise. The legal guide samuiforsale adds a practical point: putting the heir on the register later needs the landowner's cooperation, so the clause should say what the landowner will sign and when.
The moment to agree these clauses is the purchase, when the landowner is receiving the money and the contract is still being drafted. Adding them twenty years later depends entirely on the landowner's goodwill.
- Succession clause — names the heirs and the landowner's duty to register them
- Rent paid in full at the start — a sign the lease was not tied to one person
- Sublet without consent — another sign the court accepted
- Transfer permission — lets the lease be moved to a child during your lifetime
- Superficies for the house — a separate right that heirs can inherit
Worth knowingA succession clause is a promise of the landowner who signed it. If the land is later sold, ask your lawyer how that promise is protected, because renewal and succession undertakings may not bind a new owner automatically.
What happens to the house itself?
If the house is held through registered superficies, it is a separate right that heirs can inherit. Siam Legal describes superficies as the right to own a building on another person's land and notes that, unlike a usufruct, it passes to a legal heir when the holder dies; Section 1411 also allows it to be transferred unless the agreement says otherwise.
That gives a family two layers. The land lease follows the rules above and needs the right clauses to continue; the building passes as an inheritable right. The two still work as a pair, because a house without the right to use the land under it is hard to live in, so a lawyer aligns their terms.
How the house and the land lease fit together for a foreign buyer is set out on can foreigners buy a villa in Phuket.
Can you hand the lease to a child during your lifetime?
Yes, if the contract allows it. Section 544 of the Civil and Commercial Code lets a tenant pass the lease on only where the contract permits it; with that permission in the registered text, the handover is then recorded at the Land Office.
A transfer during your lifetime avoids the question of death altogether, at the cost of handing over the right now. A lawyer compares it with a succession clause for your situation; the routine they follow before any leasehold is on what a lawyer checks before a leasehold.
Whatever the route, the lease still runs to its own end date. What happens at the end of the term is on what happens when a Phuket lease expires.
What should a family put in place now?
Paperwork that matches the plan. Read the registered lease, not the sales summary, and check whether it contains a succession clause, says how the rent was paid and allows subletting and transfer. Check that the house is registered through superficies. If any of it is missing, a lawyer drafts an amendment and the landowner signs it at the Land Office.
Keep copies of the lease, the superficies and the title deed where your heirs can find them, together with the lawyer's details. A right that nobody in the family knows how to prove is hard to claim.

Questions people ask
Can my children inherit a leasehold villa in Phuket?
Only if the contract allows the lease to continue. By default a lease ends with the leaseholder, and it passes to heirs through a succession clause or terms the Supreme Court accepted, such as rent paid in full at the start.
Does a 30-year lease pass to my heirs automatically?
No. Thai law treats a lease as a personal right of the tenant, so without the right clauses it ends on the tenant's death.
Does it help that I paid all the rent up front?
Yes. Tilleke & Gibbins note that rent received in one payment for the whole term was one of the signs the Supreme Court treated as showing the lease was not tied to the tenant personally.
Can my children inherit the house even if the land lease ends?
The house can pass to them if it is held through registered superficies, which is inheritable. Using it still depends on the right to use the land, so the two documents need matching terms.
Can I add a succession clause to an existing lease?
Yes, with the landowner's agreement. A lawyer drafts the amendment and it is signed and registered at the Land Office.
What if the landowner sells the land later?
The lease itself continues after a sale, but a succession promise is a personal undertaking that may not bind the buyer of the land automatically. A lawyer checks how the clause is registered.
