Villa Lease Contract in Phuket

A villa lease in Phuket is needed not because anyone is suspected of anything, but because over months of living air conditioners break, bills arrive and plans change, and the contract says in advance what happens then. The clauses that cost money when missing are money and deposit, what the rent includes, the electricity tariff, repairs and early exit. On a one-week stay the contract can be much simpler: dates, amount, deposit.

Why does a long stay need a proper contract?

For a week, a contract mostly records the dates, the amount and the deposit, because little has time to happen. Over half a year in the tropics an air conditioner breaks, the pool pump fails, an electricity bill arrives and plans change. Without an agreed procedure each of those becomes a negotiation with an unpredictable outcome.

A contract is not protection against the person opposite. It is a decision made in advance about what counts as normal.

Send us your dates and the house you are considering in the chat. We go through the draft with you before anything is signed and remain the party you can turn to if something goes wrong. On a land lease bought for decades the contract decides even more, including whether your children keep it: see can children inherit a leasehold.

From our viewingsA verbal 'we'll sort it out if anything happens' does not work on a long lease, not out of bad intent but because three months later both sides remember it differently.

Which clauses make a contract useful?

Money first: the price, the payment schedule, the deposit, what can be deducted from it and when the balance is returned. Payment usually goes in parts, a prepayment at booking and the rest at check-in, monthly on long stays; paying six months upfront without a strong reason is not wise.

Bills second: what the rent includes and what is charged separately, electricity, water, internet, cleaning, pool and garden. For electricity, the rate per unit and the date the meter is read. Repairs third: who calls the technician, how fast a breakdown is fixed, what happens if the house becomes unusable. And early exit, where the gap between 'we keep a month' and 'two weeks' notice' can be serious money. A purchase on a long land lease needs a much longer list, covered in what a lawyer checks before a leasehold.

  • Price, payment schedule, deposit size and return terms
  • What the rent includes — cleaning, pool, garden, internet
  • The electricity tariff and the meter reading date
  • Repair timing and who calls the technician
  • Terms for leaving early
  • Rules on guests and pets, if there are any

Who signs, and in what language?

Contracts are usually bilingual, English and Thai; any translation is an appendix, and the main text is the one with legal force. Read it all, not diagonally: clauses on house rules, guests and parties can be strict, and breaking them costs the deposit.

Know who is on the other side: the owner, a management company or an agent. It decides who you go to with a breakdown and who returns the deposit. If an agent signs, ask for confirmation of their authority from the owner, because on the island there are intermediaries who let other people's houses without the owner knowing. When the deal is a purchase, checking who signs becomes part of a full title search, described in is it safe to buy property in Phuket.

Worth knowingIf the person signing is not the owner, ask for a document confirming their right to let the house. The request is normal, and a refusal is itself an answer.
04

What should you attach at check-in?

The contract describes the rules; the state of the house on arrival is recorded separately, and that part is skipped most often. Walk through with your phone and film everything already damaged: chipped tiles, scratched furniture, stains, dead sockets. Send the photos to the owner or manager that day, so both sides hold the same picture rather than two memories.

Photograph every meter close up with the date, including any separate pool or guesthouse meter. Switch on each air conditioner, test hot water, pressure on the upper floor, pool lights and internet in the far room; what you find on day one is the owner's question, what is found at check-out is yours. And count the keys, remotes and gate fobs, a list that sounds petty until one remote is missing at the end.

05

Which wording should worry you?

A bad contract is rarely hostile; it is usually empty. Worry about phrases with no deadline, no sum and no responsible party behind them. 'The deposit is returned after the house is checked', with no number of days, stretches as long as suits the other side. 'Utilities are paid as used', with no rate per unit, means the figure at check-out can be anything.

'Repairs are made within a reasonable time' means different things to someone without hot water and someone whose house works. And a signature with no named party, owner, management or intermediary, is how stories start where there is nobody to return the deposit. In a 30-year land lease the clause to read twice is the renewal; see what happens when a Phuket lease expires.

Questions people ask

Do I need a contract for one week?

Yes, but a simple one: dates, amount and deposit. The full set of clauses becomes critical on stays of a month or more.

What must a villa lease include?

Money and deposit, what the rent includes, the electricity tariff with the reading date, repair procedure and early-exit terms. Also check that the other party is named.

What language are leases signed in?

Usually English and Thai, with any other language as an appendix. The main text is the one with legal force.

I'm afraid of an agent renting a house they don't control. How do I check?

Ask for written confirmation from the owner of the agent's right to let the house. A legitimate agent provides it without fuss.

Can I leave before the lease ends?

That depends on the early-exit clause. Terms range widely, so read that part before signing rather than when plans change.

Should I pay the whole stay upfront?

Usually not. Payment normally goes in parts, a prepayment and the rest at check-in, then monthly on long stays.
